Personal Data Protection Policy
1. Who are we?
Trenker Pharmaceutical Laboratories attach great importance to the protection of privacy and personal data. This “Personal Data Protection Policy” provides information on how Trenker Pharmaceutical Laboratories, a company under Belgian law with its registered office in Zoning II, Nivelles Sud, Avenue Thomas Edison 32, 1402 Thines, and registered with the Crossroads Bank for Enterprises under number 0423.960.076, collect and process such data. It has been drawn up in accordance with EU Regulation No. 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (“GDPR”), as well as the law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data. 2. Why do we need your data?
2.1. To communicate with you and provide our products and services
Several products and services offered by Trenker Laboratories require us to obtain personal data about you in order to provide the services we have committed to deliver, or to supply the requested products. We receive information that you choose to share with us (whether via our website, social networks, or otherwise). This information constitutes personal data because it relates to an identified or identifiable natural person. It includes, but is not limited to, questions, comments, complaints, testimonials, orders, etc. Processing is necessary for the performance of a contract to which the data subject is party or in order to take pre-contractual measures at the request of the data subject. The data subject has consented to the processing of their personal data for one or more specific purposes. We use your personal data to identify you as a client in our system, respond to your phone or email requests, and provide our products and services. The nature of the services you request will determine the type of personal data we may ask for, which may include (non-exhaustive list):
- Basic personal data (first name; last name; company name; business or personal email address; business or personal phone number; business or personal postal address; city; postal code; country);
When you visit the Trenker Laboratories websites, cookies are used to collect technical information related to the services you use and how you use them. For more information on the cookies used by Trenker Laboratories, please refer to the cookie section, point 6, of this Policy.
2.2. To inform you of our activities / news
We wish to inform you about our products, services, events, or relevant news. You will receive our communication if you have given your explicit consent. For direct marketing purposes, we collect and process your name, first name, and email address.
2.3. To comply with legal obligations
Trenker Laboratories retain certain personal data in specific situations, particularly for any request for information relating to health issues connected to side effects of a product, whether related to a dietary supplement, a medical device, or a medicine. The collection and processing of such data are necessary to comply with a legal obligation to which the controller is subject in the following situations:
- Cases of nutrivigilance: post-marketing surveillance system for dietary supplements.
- Cases of materiovigilance: post-marketing surveillance system for medical devices.
- Cases of pharmacovigilance: post-marketing surveillance system for medicines.
In this context, we collect the date of occurrence of the case, your first and last name, profession, date of birth, email address, phone number, as well as information relating to the product concerned (name, batch number, expiry date, most complete possible description of the adverse effects).
3. With whom is your personal data shared?
Your personal data is shared in the three situations described below.
3.1. With Trenker Laboratories employees
Your personal data is shared only with certain Trenker Laboratories employees who need it to perform a task or service specific to their role within the laboratory.
3.2. With external service providers
Trenker Laboratories carefully select their service providers and ensure that they respect the confidentiality and security of personal data. These external providers carry out certain processing operations for us, including – but not limited to – IT, financial, and marketing services, in order to offer you our products and activities optimally.
4. Where is your data stored?
We have implemented controls to ensure the security of our information systems and data collection. Physical access to the areas where personal data is collected and processed is restricted to authorized employees.
5. How long do we keep your data?
We only keep your data for as long as necessary for the purposes described in point 2 of this Policy. Regarding direct marketing, we keep your data for 3 years. After 3 years, we will request your explicit consent again to continue using your data. Where required by law, we retain your data for 3 years. As soon as your data is no longer necessary and we are no longer legally obliged to retain it, we will permanently delete it or, if not possible, anonymize it in our systems.
6. What is our cookies policy?
This section on cookies and the consent you have given regarding the use of cookies applies to each use of our website. You have consented to the use of cookies in the cookie banner, in accordance with the terms set out in that banner and in this section. Insofar as we collect personal data using cookies, we process such data in accordance with this policy. Cookies are part of the functionality of our website. If your browser does not accept cookies, you will not be able to use this site properly. Through cookies, the site records non-personal data (number and duration of visits, preferences, etc.). This information is used to improve the site and its use, for example by displaying information based on the user’s interests. If you object to the use of cookies, you can disable them in your browser.
7. What are your rights?
7.1. Right of access
You have the right to obtain confirmation as to whether or not your data is being processed. Where it is, you have the right to request access to this data and to obtain information regarding its processing.
7.2. Right to rectification
You have the right to request that we correct your personal data if it is inaccurate or incomplete.
7.3. Right to erasure
You have the right to ask us to delete any information we hold about you from our systems under certain conditions.
7.3. Right to restrict processing
You have the right to request that we restrict the processing of your personal data under certain circumstances.
7.4. Right to data portability
You have the right to request that we transmit your personal data to you or to a third party where technically feasible.
7.5. Right to object to processing
You have the right to object to the processing of your personal data for reasons related to your particular situation.
7.6. Withdrawal of consent
If we have asked for your consent to process your personal data, you may withdraw your consent, in whole or in part, at any time without having to provide justification.
7.7. Right to lodge a complaint with the Data Protection Authority
